These Terms & Conditions ("Terms") form a legally binding agreement between you ("Client", "User", "Member", or "Coach") and ApexCoaching ("Company", "Platform", "we", "us", "our").
By accessing, registering for, subscribing to, or otherwise using ApexCoaching, you confirm that you have read, understood, and agreed to these Terms.
If you do not agree with any part of these Terms, you must not use the Platform.
ApexCoaching is a digital fitness and nutrition coaching platform. Its purpose is to connect members with trainers and nutritionists and to provide the tools they use to work together.
Through the Platform we enable:
ApexCoaching is NOT:

"Services" means the features made available through the Platform, including but not limited to workout programs, meal and nutrition programs, progress tracking, appointment scheduling, messaging, and subscription management.
"Coach" means a trainer or nutritionist who provides guidance to members through the Platform.
"Member" means an individual who uses the Platform to receive coaching, plans, and tracking.
"Content" means all programs, text, media, data, and materials made available on or uploaded to the Platform.
"Subscription" means a paid plan granting access to Services for a defined period.
The Platform facilitates the coaching relationship between members and their coaches. Where a coach operates as an independent professional, any coaching agreement is between the member and that coach.
Except where ApexCoaching expressly provides a coach as its own staff, we do not supervise the day-to-day professional conduct of coaches and do not guarantee specific fitness, body-composition, or health outcomes.
You retain full autonomy and responsibility for your training, nutrition, and lifestyle decisions.

Providing inaccurate health information may affect the suitability and safety of your programs.
Physical exercise and dietary changes carry inherent risks. Before starting, changing, or intensifying any workout or nutrition program, you should consult a qualified physician, particularly if you have a medical condition, injury, are pregnant, or take medication.
ApexCoaching and its coaches:
By participating in any program, you voluntarily assume the risks associated with physical activity and dietary change.
To the maximum extent permitted by law, you release and waive any claims against ApexCoaching arising from:
All health and training decisions are made at your sole discretion.
Guidance provided through the Platform may include coaching feedback, structured programs, and AI-supported analysis or summaries. All such content is advisory in nature and does not replace licensed medical, nutritional-therapy, legal, or financial advice.
You retain full responsibility for decisions made based on this guidance.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us promptly of any unauthorised use. We may suspend or terminate accounts that violate these Terms or applicable law.
Where you qualify as a consumer under the Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation, you may have a fourteen (14) day right of withdrawal for distance-purchased services.
Please note that, to the extent permitted by law, the right of withdrawal may not apply to digital content and services that begin with your express consent and acknowledgement that the right is thereby lost, or to services already fully performed. Personalised programs prepared specifically for you are non-refundable once delivered, except where required by law.
You may cancel a subscription at any time; cancellation stops future renewals and takes effect at the end of the current paid period.

Violation may result in suspension or termination of access and, where appropriate, legal action.
The Platform, its software, branding, design, and ApexCoaching-created materials are the exclusive property of ApexCoaching and its licensors. You are granted a limited, non-transferable, non-exclusive licence to use the Platform for your personal, non-commercial use. Unauthorised reproduction or distribution is prohibited.
You retain ownership of content you upload (e.g., progress photos, measurements, programs you create). You grant ApexCoaching a limited licence to host, process, and display that content solely to operate and provide the Services. You are responsible for ensuring you have the rights to any content you upload.
ApexCoaching processes personal data, including health and fitness data where you voluntarily provide it, in accordance with the Turkish Personal Data Protection Law No. 6698 ("KVKK") and, where applicable, the EU/UK GDPR. We apply appropriate security measures and do not sell your personal data.

To the maximum extent permitted under the laws of the Republic of Türkiye, ApexCoaching shall not be liable for:
Our maximum aggregate liability shall not exceed the total amount you paid to ApexCoaching in the six (6) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under mandatory Turkish law.
You agree to indemnify and hold harmless ApexCoaching, its officers, affiliates, and representatives from any claims, liabilities, damages, losses, or legal costs arising from your use of the Services, your content, or your breach of these Terms.
ApexCoaching shall not be liable for delay or failure to perform caused by events beyond its reasonable control, including government actions, epidemics, natural disasters, war, or third-party infrastructure disruptions.
These Terms are governed by the laws of the Republic of Türkiye.
The İstanbul Courts and Enforcement Offices (İstanbul Mahkemeleri ve İcra Daireleri) shall have jurisdiction over any dispute arising under these Terms, without prejudice to your mandatory rights as a consumer to apply to the competent Consumer Arbitration Committees (Tüketici Hakem Heyetleri) or Consumer Courts.
ApexCoaching may update or revise these Terms from time to time. The latest version will be published on the Platform. Your continued use after publication constitutes acceptance of the updated Terms.
